NSW rental information reform: distinguish assent from commencement

NSW Parliament records assent on 2 October 2026 for the rental information reform. Agencies should track commencement before treating new provisions as operative.

Parliament’s bill record confirms passage on 24 September and assent on 2 October 2026 to the Residential Tenancies Amendment (Protection of Personal Information) Act 2026, Act 38. Assent and commencement are different events. Check the enacted text, commencement instruments and regulator guidance before setting an implementation deadline.

NORMIX practical takeaway: review rental-application information, retention practices and digitally altered advertising against current applicable requirements, then track the new provisions separately. Preserve original property photographs, verify descriptions and document human approval. Existing misleading-advertising duties remain relevant. This update does not claim that every new rental provision is already in force or that identical requirements apply across Australia.
