NSW digital work systems reform: distinguish enacted and commenced duties

NSW digital work systems reform: distinguish enacted and commenced duties. Enacted; only specified provisions commenced; others await proclamation. Check coverage for each AI use case.

SafeWork NSW records assent on 18 February 2026. It states that Schedule 1 items [7], [9] and [11] commenced, while remaining amendments commence by proclamation after guidelines are developed and published. Existing WHS duties continue to matter.

Use-case investigation: identify algorithmic work allocation, performance targets, fatigue, surveillance, unsafe incentives and physical or psychosocial hazards. Record worker consultation, controls, override authority and evidence. Keep preparation for new provisions distinct from an assertion that all new duties are already operative.
