Australian Consumer Law: AI claims, outputs and customer remedies
Australian Consumer Law: AI claims, outputs and customer remedies. Existing law in force. Check coverage for each AI use case.
AI-generated marketing, recommendations and customer communications can engage misleading-conduct and false-representation rules. Relevant consumer guarantees can also apply to AI goods or services. Calling a product AI-powered does not substantiate its accuracy, safety or compliance.
Use-case investigation: retain the actual claims, intended purpose, customer group, output-checking method, complaints pathway and supplier commitments. Identify the accountable reviewer and supporting test evidence. These are practical investigation prompts; the applicable statutory test must be assessed for the particular activity.
This is an explanation of existing law, not a newly enacted AI Act. Treasury’s AI review is a review, not itself legislation.
